Legal Preliminaries

The legal preliminaries to Civil Partnership in Scotland are fully explained in a separate leaflet called - Civil Partnership in Scotland.

There is no residential qualification required for Civil Partnership in Scotland.

Civil Partnership notice forms have to be completed by both partners and returned to the Registrar where the registration is to take place, within 3 months, but at least 15 clear days prior to the marriage.

Ideally, we would recommend that Civil Partnership notice forms are submitted to the Registrar 4 to 6 weeks before the date of the Civil Partnership.

Both birth certificates should accompany the completed Civil Partnership notice forms.  Additional documents will be required if you have previously been married or in a registered civil partnership, or if you are a foreign national and subject to immigration controls.  The Registrar will advise you on these matters.

If either partner or either of the 2 witnesses to the Civil Partnership (who have to be aged 16 years or over) are unable to understand or converse fluently in English, an interpreter will have to be present at the Civil Partnership.  Please contact the Registrar for advice.

These documents can be downloaded from the General Register Office for Scotland's marriage website.

The Registrar of the district where your Civil Partnership is to take place will advise you on the current statutory fees and any additional fees.
