Your right to buy

As an existing secure tenant of Stirling Council, your rights and responsibilities and those of the Council as your landlord are currently set out in the Housing (Scotland) Act 1987.This legislation also contains the procedures involved in buying your council house.

In July 2001, new legislation, the Housing (Scotland) Act 2001 was passed. This new Act introduces some changes to the regulations covering the right to buy and these took effect from 30 September 2002. However, the Act also takes account of the rights of existing tenants in relation to purchasing their council house. The new rules only apply to tenancies allocated after 30 September 2002. The main aspects of the existing right to buy, and the new provisions, known as the Modernised Right to Buy are summarised and detailed in this leaflet.
