Permanent Closure of Croftamie Nursery

Scottish Ministers have reviewed Stirling Council’s Proposal Paper and Consultation Report relating to the proposal to permanently close Croftamie Nursery. Scottish Ministers consider that Stirling Council has fulfilled its obligations in accordance with the Schools (Consultation) (Scotland) Act 2010 As Amended and may now implement its decision to close Croftamie Nursery.

  • Nursery provision at Croftamie Nursery will cease permanently with effect from May 2021;
  • Nursery provision will be created at Drymen Primary School as of May 2021.

Stirling Council Children and Young People Committee have instructed officers to consult with the residents of Croftamie to explore the future use of the nursery building.  Council officers will make contact the local community in due course to explore the future use of the building.

On 9 January 2020, Stirling Council Children and Young People Committee considered the Consultation Report of the statutory consultation Committee Report/ Appendix 1 and  and approved the proposal to close Croftamie Nursery and relocate early learning and childcare provision in Croftamie Nursery to Drymen Primary School with effect from10 May 2021, or as soon as possible thereafter. The Children and Young People Committee was satisfied to take this decision in accordance with the Schools (Consultation) (Scotland) Act 2010 As Amended.

Croftamie Nursery does not meet the requirements of the Space to Grow document in order to provide the expanded provision of early learning and childcare. The Children and Young People Committee was satisfied that the implementation of this proposal is the most appropriate response to the reasons for formulating the proposal in accordance with Section 11A(3) of the Schools (Consultation) (Scotland) Act 2010 As Amended.

Notification and Representation to Scottish Ministers

As a result of the Children and Young People Committee's decision made on 9 January 2020 to approve the proposal to close Croftamie Nursery and move early learning and childcare provision to Drymen Primary School, the Council has informed Scottish Ministers of this decision in accordance with Section 15(2) and 2(A) of the Schools Consultation (Scotland) Act 2010 As Amended.

The legislation allows for any person to make representations either against or to support the closure to Scottish Ministers within three weeks of the Council taking their final decision to implement a closure proposal. Therefore, any representations must be made to Scottish Ministers by midnight 29 January 2020

The Scottish Ministers have a period of eight weeks following an authority's decision in which to decide whether to call in the decision or not.

On 25 April 2019, Stirling Council Children and Young People Committee agreed to a formal consultation to consider the permanent closure of Croftamie Nursery under the Schools (Consultation) (Scotland) Act 2010.

The consultation period will run from 26 April to 28 June 2019. This period allowed for the statutory minimum of 30 school days.

Consultation Report - Published 5th September 2019

At Committee meeting of the Children and Young People, 26 September an amendment was as follows:

Delete recommendations 1 to 3 and replace with the  following:

  1. The Committee notes the contents of the consultation reports at Appendix 1
  2. The Committee agrees to investigate further Option 1 as set out on page 219 of the Agenda
  3. The Committee directs the Chief Executive Officer to bring to the Committee at the earliest opportunity a detailed, costed study of the improvement that can be made to Croftamie Nursery in order to ensure the fullest possible compliance with the recommendation of 'Space to Grow.'
