Exclusive Right of Burial (Title Deed or Lair certificate)

You will be issued with an Exclusive Right of Burial (Title Deed or Lair certificate) when you buy a lair. This certificate gives the lair holder the right for him or herself to be buried within the allocated lair.

Others may also be buried in the lair only at the request of the lair holder, and with permission from the Council.

The land ownership remains with Stirling Council.

If the lair has not been used after 100 years or transferred to any other family member, the Council can end the Exclusive Right of Burial. This would be done after appropriate checks and measures have been carried out.

Current cemeteries with restrictions

You can only buy the Exclusive Right of Burial in advance in cemeteries where there is enough land resource available.

  • Blairdrummond
  • Callander
  • Logie
  • St Thomas Cemetery

In cemeteries that have enough land, lairs will be allocated in rotation, at the discretion of the Stirling Council. Lair capacity is not guaranteed as each cemetery has different ground conditions.

Purchase a lair

Applications to Purchase a Lair can be made by using the application form. Once the payment is due we will contact you for the debit or credit card payment over the phone.

Title deeds and the lair certificate will be issued to the applicant approximately 2 weeks from receipt of application and payment.

Duplicate and transfer of certificate

Title Deeds/Lair certificates can be transferred if the original lair holder has passed away. Applicants should consult with all other beneficiaries to seek consent to the transfer. Applications should be submitted with the appropriate payment to the Cemeteries service.

If your Title deed/Lair certificate has been lost or damaged you can also apply for a duplicate by applying to the Cemeteries service with the appropriate payment.

Only one person can be recorded as having the exclusive right of burial in a lair. These can not be sold or transferred without written approval from the Council. It is an offence to sell a lair to anyone other than the Council.

The Council may buy back unused lairs at the original purchase price (deducting the cost of the original Title deed/Lair certificate issue). To transfer the lair back to the Council you should write to the Cemeteries service and enclose your original documents.

Lair sizes

Lairs for stillborn babies and non-viable foetuses are available at St Thomas Cemetery and Bannockburn Cemetery. These are free of charge.
