You can seek a review or lodge an appeal when:
- Your application has been refused
- Your decision notice contains Conditions you consider to be unfair or too severe
- Your application has not been determined within the recognised timescale
- Against an Enforcement Notice, you have received
This must be done within 3 months of the Council's decision (where applicable). Please note that there is no third-party right of appeal therefore only the applicant (or representative acting on their behalf) can apply.
Appeals against refusal of planning permission, conditions attached to planning permission, or an enforcement notice are logged with the Scottish Ministers where the Inquiry Reporter's Unit considers the appeals. It makes most of the decisions, although the Scottish Ministers will make decisions in some major cases.
